Notice of the National Intellectual Property Administration on the Implementation of the Measures for the Administration of Priority Examination of Patents

The newly‑revised Measures for the Administration of Priority Examination of Patents (Order No. 85 of the National Intellectual Property Administration, hereinafter referred to as the new Measures) shall come into force officially on 1 September 2026. The Measures for the Administration of Priority Examination of Patents issued in 2017 (hereinafter referred to as the original Measures) shall be repealed simultaneously. To ensure a smooth transition between the old and new regulations and the orderly handover of priority‑examination‑related services, relevant matters are hereby notified as follows:
1.Requests for patent priority examination submitted on or after 1 September 2026 shall be handled in accordance with the relevant provisions of the new Measures. Those submitted prior to 1 September 2026 shall continue to be handled in accordance with the provisions of the original Measures.
2.Priority‑examination requests filed by parties to patent re‑examination or invalidation‑declaration cases on or after 1 September 2026 shall all be processed online via the “Patent Affairs Service” module of the National Intellectual Property Administration’s Patent Business Handling System. For detailed handling procedures, see Annex 1. The “Re‑examination and Invalidation” module of the original Patent Business Handling System will no longer accept priority‑examination applications for re‑examination or invalidation‑declaration cases.
3.For patent priority‑examination requests submitted on or after 1 September 2026, the newly‑revised Request for Patent Priority Examination form shall apply, and the old‑version form shall cease to be used concurrently. For the form template, see Annex 2. This form revision does not involve adjustments to client‑side or e‑filing data standards and specifications.
